CUSTOMER TERMS

Clear terms.
Properly agreed.

These Customer Terms & Conditions apply to work carried out by DT Property Improvements and should be read alongside the quotation provided for each project.

1. About These Terms

These Terms & Conditions apply to work carried out by DT Property Improvements.

They should be read alongside the customer's written quotation, which will specify the agreed works, price and any project-specific requirements.

Where anything in a quotation differs from these general terms, the quotation will take priority for that particular project.

Nothing in these terms affects a customer's statutory rights.

2. Quotations

All quotations are based on the information available to DT Property Improvements at the time the quotation is prepared.

The quotation will describe the work included and the agreed price. Unless stated otherwise, work or materials not specifically included within the quotation are not included in the price.

A quotation is not a contract until the customer accepts it and DT Property Improvements confirms the booking.

IMPORTANT

3. Quoted Price & Project Duration

The price quoted by DT Property Improvements is for completion of the agreed scope of work and the finished outcome.

The quoted price is not based on the total number of hours or days spent carrying out the work.

Any indication of how long a project is expected to take is an estimate only. Some projects may be completed sooner than originally estimated, while others may take longer due to preparation requirements, drying or curing times, weather, access, the condition of existing surfaces, unforeseen defects or other circumstances affecting the work.

Provided the agreed scope of work has not changed, the quoted price remains the agreed price regardless of whether the project takes more or fewer working days than originally estimated.

A shorter completion time does not entitle the customer to a reduction in the agreed price. Likewise, where completion reasonably takes longer than estimated without the scope changing, DT Property Improvements will not increase the agreed price solely because additional working time was required.

4. Scope of Work

DT Property Improvements will carry out the work described within the accepted quotation.

Anything outside that description will be treated as additional work.

If the customer asks for additional or different work after accepting the quotation, DT Property Improvements may provide an additional price before carrying it out.

5. Existing Surfaces & Unforeseen Conditions

Quotations are based on the reasonably visible condition of the property and surfaces at the time of inspection or quotation.

During preparation, previously hidden defects may become apparent, including rotten or damaged timber, corrosion, failed sealants, damp, failing previous coatings, damaged substrates, concealed repairs or other conditions that could not reasonably have been identified beforehand.

Where an unforeseen condition materially changes the work required, DT Property Improvements will inform the customer before carrying out significant additional work.

6. Preparation

Proper preparation is an essential part of achieving a professional finished result.

DT Property Improvements will determine the preparation reasonably required for the surfaces being treated.

Where existing surfaces or coatings are already defective, DT Property Improvements cannot guarantee the future integrity of material beneath the newly applied coating where that underlying failure was outside DT's control.

7. Colours & Finishes

The customer is responsible for approving the final colour and specification before application begins.

Colours may appear different on screens, printed samples, under different lighting or on different substrates.

A change of colour or finish requested after materials have been ordered or work has begun may result in additional charges.

IMPORTANT

8. Deposits & Cancellation

DT Property Improvements may require a deposit to secure a project.

Deposits may be used towards costs committed specifically for the project, including materials, equipment hire, specialist products, preparation costs and reservation of labour or project time.

Cancellation 7 or more days before the start date

Where the customer cancels at least 7 days before the agreed project start date, DT Property Improvements will normally refund the deposit.

DT Property Improvements may deduct reasonable non-recoverable costs already incurred specifically for that project where applicable.

Cancellation less than 7 days before the start date

Where cancellation occurs less than 7 days before the agreed start date, DT Property Improvements may retain some or all of the deposit where reasonably necessary to cover genuine costs or losses resulting from the cancellation.

DT Property Improvements will not retain more than is reasonably required to cover its genuine loss.

9. Statutory Cancellation Rights

Where applicable, customers may have statutory cancellation rights, including where a consumer contract is entered into at a distance or away from business premises.

Any statutory rights that apply will take priority over DT Property Improvements' normal cancellation policy.

10. Starting Work During a Cancellation Period

Where statutory cancellation rights apply and the customer asks DT Property Improvements to begin work before that cancellation period has ended, DT may obtain the customer's express request to begin the services early.

If the customer subsequently exercises a valid cancellation right after work has begun, they may be required to pay a reasonable amount for work already performed up to the point of cancellation.

11. Start & Completion Dates

Any proposed start date or completion period is provided in good faith.

Unless expressly agreed otherwise in writing, dates should not be treated as guaranteed deadlines.

Projects may be affected by weather, drying or curing conditions, supplier delays, equipment availability, illness, access problems, unforeseen property conditions or work being carried out by other contractors.

12. Weather

Exterior spraying, painting, coating and other property improvement work may depend upon suitable environmental conditions.

DT Property Improvements may postpone, suspend or reschedule work where weather or surface conditions could compromise safety, adhesion, curing, application, finish quality or manufacturer requirements.

13. Customer Responsibilities

The customer must provide reasonable access to the property at the agreed times.

Where reasonably required for the work, the customer must provide access to electricity and water unless otherwise agreed.

The customer should remove or secure fragile, valuable or personal items from areas where work will take place and disclose relevant access restrictions before work begins.

14. Changes Requested by the Customer

Changes requested after a project has been accepted may alter the price, require additional materials, extend the project or affect the agreed start or completion period.

DT Property Improvements will communicate any material price change before proceeding with changed work where reasonably practicable.

15. Payments

The quotation will specify the required payment arrangement.

Unless another arrangement is agreed in writing, any remaining balance becomes due upon completion of the agreed works.

16. Completion & Snagging

When the agreed works are substantially complete, the customer should inspect the work and raise any reasonable snagging items promptly.

DT Property Improvements must be given a reasonable opportunity to inspect and, where appropriate, remedy genuine defects relating to its work.

17. Work by Other Contractors

DT Property Improvements is not responsible for damage to completed work subsequently caused by other contractors, tradespeople, the customer, occupants, accidental damage, misuse or alterations made after completion.

18. Photographs

DT Property Improvements may ask the customer for permission to use photographs of completed work for its portfolio, website and social media.

Where consent is requested separately, the customer is not required to provide that consent in order to accept a quotation.

19. Complaints

If a customer believes there is a problem with the work, they should contact DT Property Improvements as soon as reasonably possible so the matter can be inspected and an appropriate resolution considered.

20. Consumer Rights

Nothing within these Terms & Conditions excludes or restricts rights that cannot legally be excluded or restricted.

DT Property Improvements will provide its services with reasonable care and skill as required by applicable law.

21. Governing Law

These Terms & Conditions and contracts entered into under them are governed by the laws of England and Wales.
